Criminal Records Check Options

Performing a Criminal Records Check May Perhaps Be a Very Smart Decision!

Did you know that every arrest that is made in this country is documented?
There is even software available to the public that will predict if someone has the tendency to commit a criminal act, which is very frowned upon at this time as being a form of profiling, and is not recommended. The law enforcement agency that makes the arrest is responsible for taking the finger prints of the suspect and documenting other mandatory information like the time of the arrest, reason etc. and to save the information which is then archived in the states central criminal arrest records repository.

Every state has a department responsible for maintaining and keeping these records up to date and in turn each law enforcement agency has the responsibility to record every arrest that is made on a daily basis. Although the outcome of the arrest is not stated in the public criminal records. Additionally every state has a set of laws regarding the criminal records but in almost all the states the records are open to the public. Anyone can request a criminal records check. There is specific process and each state has different charges and slightly different regulations. An application form must be filled out and finger print cards collected from the specific government offices.

The items, after completion, should be posted to the concerned department and the fee submitted along with a self addressed and stamped envelope for the results. Be advised that the waiting period, for the results, can range from 5 to 15 or more working days in different states and the criminal records are usually easy to request, except if requesting the records of a third person, you must present a consent document in order to get the results. Certain employment agencies have the right to check the criminal records of their employees but of course with consent. Furthermore, in some states there are on-line portals that offer public arrest records and criminal record checks as well as name searches that can also be conducted. The process is more or less the same and takes as many days as the normal procedure through the mail only the request is sent via email instead of postal.

It must be noted that as per the law of each state there are some records that cannot be disclosed, regardless of the claims that are made. Usually these types of criminal activities are for Law enforcement agencies and F.B.I eyes only and usually involve the ongoing court cases, juvenile records, expunged cases or cases that the court has sealed. Particular law enforcement agencies again, such as the F.B.I, can access these records when need be, under special circumstances.

Each state is also responsible for maintaining the records of an arrest that takes place within that states border. They can share the information with other law enforcement agencies on request though there is however a centralized repository that holds the nationwide criminal arrest records that is maintained by the Division of Criminal Justice Information Services (CJIS) of the Federal Bureau of Investigation (FBI). These records reveal misdemeanor, felony, probation, inmate and sexual misconduct or the absence etc. There are several situations in which it is deemed mandatory for a person to present his or her criminal records. For example at times an individual may also want to request a copy of the records in order to challenge that information deemed against them. In many cases, in the United States, background checks are required for employment and licensing depending of course what is being applied for. In order to get these records, or the “no record” response, an individual needs to contact the state identification department, local police or any authorized channeling agency.

Requesting fingerprints for a criminal records check

Criminal FingerprintsThe request for a criminal records check can also be made directly to the FBI, especially when requiring a nationwide search. There is also an option of going through a channeling agency authorized by the FBI. One drawback of requesting the records from a channeling agency is that the agency cannot authenticate the finger print records. In order to get authenticated finger print records one must make the request directly to the FBI only.

If the record is clear a “no record” document will be issued otherwise a rap sheet or identification record sheet will be given. US citizens may also be asked to present “Lack of criminal record” or “certificate of good conduct” when the adoption of a child is in question. The certificate may also be requested if an individual wants to reside abroad. In many cases the records are requested for tenant screening or loan lending purposes too.

In some cases the physical presence of the person who is requesting the information is mandatory, at the local law enforcement agency and finger print set’s are taken on sight then sent in for a criminal background check. The Police department delivers the results along with their physical description of the subject at the time of the request. Usually local law enforcement agencies take relatively less time in giving out the results but the nationwide search takes a little longer just because of the sheer size of the database. In more severe cases, when officially required, the criminal records check should, again, be done by the FBI. although, otherwise it has become quite easy to get criminal background records on-line. There are many third party non-government information providers that provide nationwide public background records instantly at a very fair cost and at times a background check may not be officially needed at all but for personal reasons only. In that case any such information provider is the best source.

In 1966, President Lyndon B. Johnson signed the Freedom of Information Act. This was the first step towards providing the public a chance to exercise their right of individual safety. By making these records open to everyone greater levels of safety are ensured for everyone. With the increase in violent and sexual crimes it has become very difficult to trust anyone at all and sometimes it might not be possible to gain access to the federal criminal records or it may be too long a waiting period. Luckily, reliable and quick access to information is available through Internet Services like these and can help ensure everyone more peace of mind. Also allowing more confidence in that, the people they are interacting with, in everyday life, are of a safe nature.

Finally, an instant criminal records check can come in really handy when you are hiring someone like a gardener, a handy man or a governess, or even if you are subletting your property or have moved to a new place and are surrounded by new people who are total strangers to you. So if you have an uneasy feeling about someone don’t wait for it to go away on its own go online and lay your suspicions to rest once and for all.

And remember, Hesitation can bring regret!

Public Arrest Records and What You Should Know

We meet different people every day, and during your daily activities you may have to deal with people you barely know. With such interactions, new relationships are formed; be it a work relationship, neighborly, friendly or even a romantic relationship. Are you in any of these relationships with someone you barely know? Well, it’s about time you did some digging around and find out who this new person in your life really is… whether it’s a neighbor, a friend or a nanny you wish to hire. A good place to start will be the person’s public arrest records.

Social media is usually a common place most people will start their search. Well and good, but is the information obtained from a social site whose profile they themselves created credible enough? What you need is to do a search on their public records.

Indeed, a person with an arrest record will not have a mark on their forehead saying they have such a record; and let’s face it, they won’t give it to you straight either. I dare say if you are to let anyone into your life or around your family, be sure that they are safe to be with. You may be letting a rapist date your daughter! Take action and carry out the search on the person’s arrest records. You will be surprised what information you may find in such public records.

Information contained in public arrest records

Police making a public arrestArrest records usually contain a description of the individual arrested, their particulars, and specific details regarding the arrest; the offense committed, time of arrest, place of arrest, warrant, arresting officer and the case number.

Some private information may also be derived from a person’s public record search. Such may include their date of birth, tax records, phone numbers, address, etc. Information regarding juvenile delinquents is usually not made available to the public.

This type of information may also contain a number of various cases. Small offenses usually include driving while under the influence of alcohol, speeding, harassment etc. On the other hand, murders, sexual assaults, and burglaries constitute felonies. There are a number of various crimes that may appear in a person’s criminal history search and while public arrest records are not considered criminal offenses, they will show up as an aspect of the criminal incident that occurred. Typically, any action by an individual or group which is in violation of human rights or property is considered, by law, to be a crime.

What public arrest records are commonly used for

Information that you may find in a person’s public record files usually varies with jurisdictions of different states. Whatever information you obtain will help you make informed decisions regarding job applicants, interactions with your neighbors, or even the new romantic relationship that you are so excited about.

Here are some common instances where you may need to obtain a person’s public arrest records.

As an employer, you want to be sure that you are hiring someone you can trust to run certain aspects of your business. This means that you have to be cautious about who you employ. Once you hire someone, they are able to access certain crucial information, company finances or other assets. To be sure that such access is given to the right person employers will run a background check prior to hiring. Searching a person’s arrest records alone can provide you with vital information regarding their lifestyle and what type of person they may be.

Imagine having a tenant with a criminal arrest record that includes burglary or vandalism! You surely wouldn’t expect them to comply with your conditions for tenancy would you? Entrusting such a person with your property will certainly pose the risk of theft, vandalism, possible non-payment or even threats on the lives of other tenants. All these can be avoided if you do a quick search of every new tenant’s criminal and public arrest records.

How much do you value your children and your home? If you really love your family, you wouldn’t just entrust anyone with the care of your children while you are away. You have probably seen or heard of the horrible things that some nannies have done to the children of unsuspecting parents. Most of these incidences are even caught on “Nanny Cams”.
Do not be one to hire a nanny without running a search on them. They may be hiding bad things behind that pretty face and cute smile. Running an arrest records search to help make a determination may just be the difference between hiring a jewelry addict or a real child-loving caring nanny.

Be forewarned that it is unlawful to use these types of searches for discriminatory purposes when hiring anybody, unless you have the subjects permission.

*Checking on your Neighbors
We cannot choose who we want to be our neighbors. However, when it comes to a matter of safety and security, you may demand that a person be asked to move out of the community. A persons public arrest records may be used to back claims that a particular neighbor is a possible threat to the neighborhood.

Types of public arrest records

Man in jail after being arrestedArrest records are public records and usually made available to the general public upon request. There are two types of these records, being free of charge records and fee-based.

Local and state government offices/repositories, police departments and the FBI agencies are usually the main sources of free of charge arrest records.

It is also not uncommon to search and find public records from commercial providers for free. However, charges apply for detailed reports or information downloads.

While free-of-charge records will have the required information for a casual search on the neighbor or your daughters new date, they usually are shallow when the search is for official or legal purposes. In such a case, paid professional records are preferred. This is because they offer a detailed analysis of a person’s profile and arrest record history. You can get almost any kind of information you need on a person’s background pulled from commercial paid services.

How and where to obtain public record information

Public arrest records may be obtained from the relevant sources (government agencies, police departments or public records search service providers) by mail, fax, in person or over the Internet.

You can contact the State Police department and request an individual’s arrest records as well. The contact person will instruct you on how you can obtain the information you requested. If you follow the procedure provided, you will receive a copy of the requested records. Normally, these are issued for free, however a nominal fee may apply to cover copying and printing costs.
Usually, obtaining arrest records from local law enforcement or any other relevant government office will require that you make a written request. This normally takes time before you receive the requested information, though there are faster ways to obtain the same information.

The Internet is a faster source for obtaining public records. There are a number of online directories and public records search tools that will quickly provide information on an individual’s background records. These online platforms are convenient since they are simple, easy to use and most of them are free, if you don’t mind doing the research legwork. What’s more, you can carry out the search right where you are using your mobile device or at home on your computer.

The most effective way to get all the information you need on a person’s arrest history is to subscribe to a paid public record search service. Whatever information you request will usually be made available to you using an appropriate analysis. The fee’s to access these records are nominal compared to the time needed for searching all of the various repositories needed to obtain an accurate report.

If you feel the need to run a criminal or public arrest records search on someone you will be interacting with, then it is best if you leave the task to a third party service. They will have access to vast databases and proprietary sources, including government agencies, law enforcement offices as well as social media profiles that may have relevant information on the person you are researching.

Sex Offender Records Check

Sex offender records are of utmost importance

There may come a time in life when possibly anyone would need to do a criminal records check. Most people think about felonies or arrest records when they think of criminal records. Often even identity theft offenses are considered as a common form of criminal activity, but there are other types of offense records that are far more important and those are sex offender records. Everyone with children should be concerned with the sex offender registry when it comes to trusting people around their children. Some may say that this is too much information, and that it makes people paranoid, but we happen to think this particular registry is one of the best sources of information to have been implemented in a very long time.

This type of criminal background check will tell you if someone has a past that involves sex offenses with anyone under the age of 18 or non-consensual. Anyone who has been found guilty of this type of offense must register where they live, where they work, and even where they attend school, in some cases. This means that anyone looking up this type of public criminal record, in regards to their own area, will know if such a person is living nearby. As your children grow and begin to spend time at their friends houses and mingling with other people, it is important that you have access to data of this nature for their well being.

Unfortunately not all of the information that is retrieved when doing a sexual predator record search will be relevant. Sometimes the records may not have been updated at that time, an offender has some how managed to avoid registration or some offenders have been removed from the database due to a particular states regulations or even Not removed. In the case where an offender has been legally removed from the sexual predator database, some offenders are removed by petitioning to do so and have met that particular states minimum registration requirements. In other states though, sex offenders stay in the database for life.

Sensitivity when using sex offender records information

Keep in mind that some offenses are ridiculously minimal, for instance urinating in public. Were as other offenders are relinquished from their registration duties because they have simply served out their states minimum requirements. In this case, we feel this should not be allowed, in regards to serious convictions. Don’t you want to know if you live near a serious convicted sex offender? We recently implemented a criminal records search for our own local neighborhood. In the last two years the number of predators in this small community have jumped from a few offenders to seventeen. Not only that, one is only a little over a block away. The proximity of it all kind of gives us the creeps but it is far better knowing where they are and what they look like, so a person can steer clear of them.

When you look for these types of criminal offenses or any public criminal records; be careful how you use the information you’ve obtained. You can not use this information to harass anyone that is associated with the sex offender list, but you can use the information to help ensure the safety of your loved ones.

Some of the sex offenders may have in fact been rehabilitated or were (as mentioned) convicted of very minimal offenses, but you just never know. It’s hard to imagine that anyone with that sort of impulse can simply turn it off because of the fact that they were caught. However, it can happen. You have to use the background records you retrieve about a person very carefully. Though, always run a sex offender records check when someone associates with your children, especially if something does not feel right or makes you uneasy.
